Police Interview

You now have the right in Scotland to speak with a solicitor while in police custody, whether or not you are to be interviewed by police officers. If an interview is to take place then you have the right to have a solicitor present. Ask for McKennas Law Practice while if you are in police custody and we can provide fast and effective advice which may have a crucial impact on the case against you.

Court

If you have received a citation for court or been released on an undertaking by the police, now is the time to speak with an experienced criminal defence lawyer. We regularly deal with cases before the High Court of Justiciary, the Sheriff Court, the Justice of the Peace Court and the Children’s Hearing. We know that a criminal charge, however serious or minor, can have a profound impact on the life of the accused person and their family. We appreciate the concern that person might have about loss of employment or imprisonment if they were convicted. Let us help to achieve the best possible outcome.

Post – Conviction

For those persons who have already been to court, we are able to advise on whether an appeal against a conviction or sentence might be appropriate and for those persons who are in custody serving a prison sentence we can offer representation before the Parole Board for Scotland.

Family Law

Any problem involving your children or other family is likely to be distressing. Our solicitors are experienced in dealing with difficult issues in a variety of areas:

Contact and Residence

The issues of who should look after a child and who should be able to see a child are often very difficult to resolve without professional assistance. We can negotiate on your behalf and, if necessary, raise or defend an action at court to ensure that the welfare of the child is properly protected as soon as possible.

Divorce and Separation

The end of a relationship might not only be an emotional time, it might create issues regarding property and children that need to be resolved as quickly and painlessly as possible. The sooner you seek advice, the sooner we can start to help. Our experienced team will do their utmost to ensure that the case is concluded to your satisfaction.

Children’s Referrals

If you are required to appear before the Children’s Hearing or simply require some advice about problems relating to a child, speak with one of our solicitors. We can offer advice and representation to help you through what may be a very difficult time.

Mental Health

Our firm offers vast experience in dealing with all aspects of mental health law. Since the introduction of the Mental Health Tribunal for Scotland in 2005, our solicitors have appeared frequently on behalf of patients subject to all types of order and named persons. We act on behalf of clients in the State Hospital, medium and low secure facilities as well as in the community. If you wish to appeal against your order, detention in hospital, transfer or level of security, we can help. We are often engaged by persons subject to criminal proceedings who are detained in hospital or who may have mental health issues.
